Terms of Service
1. Agreement and Scope
1.1 Parties and Services
These Terms of Service (the "Terms") constitute an agreement between you and LaneTrax Inc., a Delaware corporation ("LaneTrax", "we", "us", or "our"). They cover the LaneTrax iOS application (the "App"), our public websites, including authentication and discount pages, and related account, support, referral, and promotional services (collectively, the "Services").
1.2 Acceptance
You agree to these Terms by creating an account, downloading, installing, accessing, or using the App or Services, purchasing a subscription, or redeeming an offer, where we first provide conspicuous notice that the action constitutes acceptance and a reasonable opportunity to review these Terms. Merely visiting a public page without that notice does not constitute acceptance. If you do not agree, do not proceed with the action identified as acceptance. Any express agreement required by applicable law will be obtained separately.
If you accept on behalf of a business, you represent and warrant that you have authority to bind it. That business is the customer responsible for the business-use payment and contractual obligations. Each named individual using its account must accept the applicable use restrictions and permissions, but does not personally guarantee the business's payments or indemnity merely by operating the account. Otherwise, you contract in your own capacity. Consumer status and mandatory rights depend on applicable law, not solely on an account label or employer payment. Each account remains assigned to one named individual under Section 2.
1.3 Relationship to Privacy
Our Privacy Policy explains the processing of information that identifies or can reasonably be linked to a person ("Personal Information"). These Terms govern the contractual use of the Services; they do not replace a privacy notice, consent, or other authorization required by law. The Privacy Policy governs our handling of Personal Information if these documents conflict on that subject. Mandatory legal rights prevail over both documents.
2. Eligibility, Accounts, and Business Use
2.1 Adults Only
By creating a LaneTrax account, you confirm that you are at least 18 years old and have legal capacity to enter this agreement. You must not create or operate an account for a minor or permit a minor to use your account. Parental permission does not make an under-18 person eligible.
2.2 One Named User per Account
Personal use and use for a business, coaching practice, team, or organization are permitted. Each account is for one named individual on devices that individual owns or controls, including authorized business devices. You must not lend, sell, transfer, or share an account or its sign-in links with friends, coworkers, clients, affiliates, or other people.
If you authorize people to use LaneTrax for your business, each person must use a separate account with any required access entitlement. Permission for one business does not extend to related companies or other entities through a shared account. This does not prohibit coaching another person or analyzing their shots with the necessary permissions; the account holder must remain the person operating the Services.
2.3 Account Security
You must provide accurate account information, keep it reasonably current, take reasonable steps to protect your devices and sign-in credentials, and promptly notify LaneTrax when you become aware of suspected unauthorized access. You are responsible for activity you authorize and for your failure to meet these security obligations. This does not make you responsible for a security failure attributable to LaneTrax or remove our own duties.
For business-paid accounts, the business and named user should arrange continued access and billing before employment or other authority ends. Do not transfer credentials to a replacement worker. Contact us to arrange any permitted change. Business payment does not by itself authorize access to another person's Personal Information or give the business ownership of that person's content; rights and access remain subject to applicable permissions, the Privacy Policy, and law.
3. App License and Restrictions
3.1 License to Use the App
The App is licensed, not sold, to you. Your license to the App is subject to your acceptance of these Terms. LaneTrax grants you a limited, non-exclusive, nontransferable license to use the App on compatible products branded by Apple Inc. ("Apple") that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, subject to any required subscription. The license permits the personal and business uses described in Section 2, not resale or sublicensing of the App.
Where Apple's applicable Usage Rules permit access through Family Sharing or volume purchasing, this license permits that access. This does not promise availability of an optional sharing feature or permit sharing LaneTrax credentials: each person using the Services must have their own eligible account and any required entitlement.
These Terms govern content, materials, and services accessible from or purchased within the App, as well as upgrades provided by LaneTrax that replace or supplement the original App, unless an upgrade is accompanied by a separate license agreement. LaneTrax reserves all rights in the App not expressly granted to you by these Terms or applicable law.
3.2 Software Restrictions
Except as provided in Apple's Usage Rules, you may not distribute or make the App available over a network where it could be used by multiple devices at the same time. This does not prevent the named account holder from separately installing and using the App on their own permitted devices. You may not transfer, redistribute, rent, sell, or sublicense the App. If you sell or transfer your Apple device to another person, you must remove the App, sign out, and remove locally stored account information before doing so. Removing the App does not delete your cloud account or cancel a subscription.
You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof, except as and only to the extent that a restriction is prohibited by applicable law or the activity is permitted by the licensing terms governing open-source components included with the App. You must not remove proprietary notices.
3.3 Acceptable Use
You must not use the Services to:
- Violate laws or another person's privacy, intellectual property, or other rights.
- Record people without required permissions, or harass, stalk, impersonate, or deceive anyone.
- Access other accounts or systems without authorization, distribute malicious code, or disrupt the Services.
- Scrape or collect data through unauthorized automated access, or bypass security or access controls.
- Use phishing, deception, or other unauthorized means to obtain another person's password, sign-in link, payment information, or other private information.
- Send unsolicited bulk messages or spam, or run automated processes that interfere with the Services or place an unreasonable load on their infrastructure.
- Misrepresent eligibility for an offer, manipulate referral activity, or obtain paid access fraudulently.
Nothing here prohibits legally protected activity, exercising privacy or consumer rights, or requesting a lawful refund.
4. Features, Accuracy, and Safe Use
4.1 Analysis and Shot History
LaneTrax uses computer vision to provide bowling measurements, insights, saved shot history, and its video replay feature ("Replays"). Outputs are estimates and may be incomplete or inaccurate. Camera position, lighting, device performance, and other conditions can affect results. We do not guarantee improved bowling performance or that measurements qualify as official scoring, certification, or professional advice.
4.2 Safe Recording
Use reasonable care when positioning and operating your device, and comply with applicable venue rules. Recording permissions are addressed in Section 7.
4.3 Technical Requirements
Some features require compatible hardware, permissions, current software, or a network connection. You are responsible for providing the equipment and connection needed for the features you choose to use and for applicable carrier or internet charges. Recording, processing, or uploads may fail; the App is not a substitute for keeping independent copies of material important to you. Service changes and interruptions remain subject to Sections 12 and 13.
5. Subscriptions, Trials, Payments, and Refunds
5.1 Paid Access
If you purchase a subscription, you agree to pay the price and applicable taxes confirmed through Apple's in-app purchase system. We will disclose the features, price, billing period, trial or introductory offer, and applicable taxes in the purchase process before you confirm. Prices and availability can vary by territory and offer. We do not receive your full payment-card credentials from Apple.
Annual subscription prices may be displayed as a monthly equivalent for comparison. This is not a monthly payment plan: annual subscriptions are billed once per year at the applicable total annual price. When you tap the purchase button, Apple's confirmation sheet shows the total annual charge before you authorize the purchase. Review that amount and the billing period before confirming.
The total charge for the billing period, any introductory price, and the subsequent renewal price will be clearly presented before purchase. A monthly equivalent does not replace disclosure of the total annual charge.
5.2 Renewal and Cancellation
Subscriptions renew automatically at the billing interval and price disclosed through Apple unless you cancel by Apple's stated deadline. Payment authorization is given through Apple's purchase process, not merely by creating a LaneTrax account. Manage or cancel renewal through Apple's Manage Subscriptions page. Cancellation normally stops the next renewal rather than ending an already-paid period immediately, subject to Apple's terms and applicable law.
5.3 Trials and Introductory Offers
Standard introductory trials are limited to one per person, regardless of the number of LaneTrax or Apple accounts used. You must not create or use additional accounts to obtain another standard introductory trial or otherwise bypass trial eligibility restrictions.
LaneTrax may expressly offer eligible users an additional trial through a reactivation or other promotion, including users whose previous trial did not convert to a paid subscription. Such a trial is permitted only under that promotion's stated conditions and does not create an entitlement to further trials.
Trials and introductory offers are subject to the duration, eligibility conditions, and subsequent subscription price disclosed when you accept the offer. You must meet both LaneTrax's offer conditions and Apple's applicable purchase requirements; Apple's ability to process a trial does not override the limits above. Unless the offer states otherwise, a trial converts to a paid subscription unless cancelled within Apple's stated deadline.
You can enable an optional trial-ending reminder on the subscription purchase screen. If enabled, we schedule an email to your LaneTrax account's email address for 48 hours before your trial ends, but do not guarantee delivery or receipt. Email-provider delays, spam filtering, or an incorrect account email address may prevent it from reaching you.
The reminder does not cancel your subscription or extend Apple's cancellation deadline. Do not rely solely on the reminder. If you do not want your trial to renew, cancel through Apple at least 24 hours before it ends using Apple's Manage Subscriptions page.
5.4 When Paid Access Ends
After a trial or subscription expires, LaneTrax will continue to permit you to view your existing shot history, subject to lawful account restrictions and the service-change provisions below. New analysis and other paid features require a valid entitlement. Cancelling a subscription does not delete your account or content, and deleting your account or uninstalling the App does not necessarily cancel an Apple subscription.
5.5 Refunds and Price Changes
You may request Apple-billed refunds through Apple's refund request page and contact us for assistance with access or a purchase issue. Section 5.6 sets out our satisfaction guarantee. Apple's role does not remove rights or remedies you have against LaneTrax under mandatory law. Price changes for future renewals are subject to Apple's notification and approval requirements and any additional requirements of applicable law.
The satisfaction guarantee is separate from statutory cancellation or withdrawal rights. Where applicable law requires withdrawal information, a cancellation form, or your express request for performance during a withdrawal period, that information or request will be provided in the purchase process. Merely opening or using the App does not waive a statutory withdrawal right. Any loss of such a right requires the conditions imposed by applicable law to be met. Contact us for assistance without losing rights against LaneTrax merely because Apple processes payment.
5.6 30-Day Satisfaction Guarantee
If you are not satisfied with LaneTrax, you may request a full refund of your first-ever paid LaneTrax subscription payment within 30 calendar days of that payment. This applies once per person, across accounts, to your first monthly or annual subscription payment, including your first paid charge after a free trial, but does not cover renewal payments.
Submit your request through Apple's refund request page within that period. If Apple declines an otherwise eligible request, contact us at contact@lanetrax.app with proof of purchase and the refund decision, and we will reimburse the amount you paid. If Apple's refund process is unavailable or will not accept the request, contact us within the same 30-day period; that timely contact preserves eligibility while we help you seek an Apple refund or verify reimbursement. You cannot receive both an Apple refund and a LaneTrax reimbursement for the same amount.
Timeliness is based on when you submitted the request to Apple or contacted us under the unavailable-process fallback above, not when review finishes. You do not need to demonstrate a technical defect or complete troubleshooting. We may verify the purchase and request to prevent fraud or duplicate reimbursement.
We will issue an eligible direct reimbursement within 14 calendar days after receiving the information reasonably needed to verify the claim. It covers the amount actually charged, including applicable taxes, less any amount already refunded for that payment; it is not reduced by Apple's commission. We will use the purchase currency and, where available, the original payment method, or agree a reasonable alternative with you if we cannot refund through Apple. We will not charge a reimbursement fee. Do not send full payment-card details or account passwords.
Requesting a refund does not necessarily cancel future renewals. Manage cancellation through Apple's subscription settings. This guarantee is additional to your statutory rights.
6. Discounts, Referrals, and Promotions
6.1 How Discount Codes Work
LaneTrax discount codes determine eligibility for an introductory or other promotional offer on an Apple in-app subscription. They do not create a separate subscription or billing arrangement. The discount, applicable plan, and offer conditions are those disclosed for the particular code and purchase.
6.2 Eligibility
You must meet the offer's eligibility conditions and Apple's applicable purchase requirements. New-user codes are not valid for previously subscribed users unless the offer expressly permits it. We may offer separate promotions for returning or previously subscribed users; this does not make them eligible for existing new-user offers. The trial restrictions and promotional exceptions in Section 5.3 continue to apply.
6.3 Applying, Replacing, and Redeeming Codes
Apply the code through the supported LaneTrax flow and complete any required Apple redemption or purchase steps. Viewing a discount page, scanning a QR code, or saving a code does not complete an Apple purchase. Check the offer and price shown before confirming.
You may have one current LaneTrax code assignment at a time. Before redemption, you may replace it with another eligible code; the new assignment replaces the pending offer rather than combining the discounts. Codes do not stack. Changing a saved code does not reprice an already completed purchase.
6.4 Discount Duration and Renewal
A discount lasts for the period disclosed in the offer. After that period, the subscription renews at the disclosed regular price unless cancelled, subject to Section 5 and applicable Apple requirements. A code does not entitle you to lifetime pricing or a trial beyond what the offer expressly provides.
6.5 Availability, Expiry, and Withdrawal
Codes may have stated redemption deadlines, usage limits, and distribution restrictions. We may stop accepting new assignments of a code. If we do, we will honor otherwise valid assignments already saved through a supported LaneTrax flow, on the offer terms applicable when saved. Saving a code does not extend its stated deadline or remove its eligibility conditions. Withdrawal from new use does not change the terms of a completed Apple purchase.
6.6 Sharing and Misuse
Public discount and referral codes may be shared unless the particular offer restricts distribution. Personally allocated Apple redemption codes and links are for the intended recipient and must not be sold or transferred. Sharing a public code does not authorize sharing a LaneTrax account.
You must not refer yourself, misrepresent eligibility, create false accounts, or use additional accounts to bypass offer or trial limits. We may verify eligibility and reject or reverse improperly obtained benefits where lawful. We will not withhold a valid benefit merely because you exercise a legal right.
6.7 Referral Rewards
Eligible referrers may earn shammy rewards under the Shammy Giveaway Terms. Those terms govern qualifying referrals, eligibility, reward limits, verification, redemption, and sharing restrictions. Applying a code or starting a free trial alone does not earn a reward. The general sharing permission above does not override that promotion's restrictions.
6.8 Late Requests and Other Rights
Codes are not automatically applied retrospectively, and forgetting to use one does not create a right to a price adjustment. Support may make a discretionary exception. This does not limit the satisfaction guarantee in Section 5.6 or your statutory rights. Offer-specific terms govern the details of that offer, such as eligibility, qualifying referrals, prices, deadlines, and reward limits. They do not override these Terms' dispute-resolution provisions, privacy commitments, or mandatory rights. Section 16.1 explains the document hierarchy and treatment of earlier accepted offers. The Privacy Policy explains display of referrer names and the handling of code and campaign information.
7. Content Ownership and Recording Permissions
7.1 Your Content
You retain whatever ownership and other rights you hold in content you provide through the Services ("User Content"). This includes recorded bowling clips, available audio, diagnostic camera images, and associated shot data ("Bowling Content"), as defined in the Privacy Policy. Associated shot data includes results, metrics, trajectories, detections, processing histories, and account, session, camera, and recording details. User Content also includes material such as support submissions. These Terms do not imply that you own another person's image, voice, or other rights.
7.2 Required Permissions
Before recording or uploading, you must provide required notices and obtain all consents, releases, and permissions needed for the recording, submission, and App features you request. You represent and warrant that you have the rights necessary to provide the content and authorize those activities without infringing another person's rights. This applies to every person whose image or voice is included and to any relevant venue or third-party material. You must not submit content if required permissions are missing.
Device permissions and your own agreement do not supply another person's consent. A person's presence in a public bowling venue is not automatic permission for every use. You must not knowingly submit Bowling Content that identifies anyone under 18. If you discover that such content has been uploaded, contact us promptly through the Privacy Policy's request process to request its review or removal. The adult-only account rule does not authorize use of a minor's information. Your responsibilities do not replace LaneTrax's own legal obligations or any permissions we must obtain.
The licenses in Section 8 extend only to rights you actually hold. You are not required to warrant that you already possess releases for an unspecified future advertising campaign or third-party research project. Before a secondary use begins, LaneTrax must establish the rights, legal basis, and additional permissions needed for that particular use. If we ask you to authorize a specific additional use, you must have any permissions necessary for the authorization you give.
7.3 Content Concerns
We may restrict content where reasonably necessary to address illegality, missing permissions, security, or a rights complaint. A person shown or heard in content may use the privacy request process without having an account. The Privacy Policy explains review, restrictions on disputed recordings, and deletion requests.
If you believe material on the Services infringes your copyright or other rights, contact us using Section 16.5. Identify the material and where it can be found, explain the rights involved and why you believe they are infringed, and provide contact details and your authority to act if reporting for someone else. Provide only information reasonably necessary to assess the concern; do not send passwords or unrelated sensitive information. You do not need a LaneTrax account to report a concern.
We will review the information supplied and may request clarification or supporting evidence. Where appropriate, we may restrict or remove affected material and notify the account holder. A report alone does not establish infringement. An affected account holder may contact us with an explanation and supporting information, including evidence of permission or mistaken identification, to request review. These procedures do not limit statutory notice, counter-notice, court remedies, or privacy rights.
7.4 Repeated Infringement
We may restrict or terminate accounts of repeat infringers in appropriate circumstances. We will consider substantiated reports, the account holder's response, the seriousness and repetition of the conduct, and applicable law. Repeated allegations alone do not automatically establish repeated infringement. Account restrictions and any opportunity to resolve an issue follow Section 12.2, subject to any action required by law.
8. Content Licenses and Permitted Uses
8.1 Providing the Services
To the extent you hold the necessary rights, you grant LaneTrax a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, convert, analyze, and display User Content as needed to provide the Services you request, including shot analysis, Replays, history, synchronization, and support. We may permit service providers to perform these activities on our behalf for those purposes. This license does not transfer ownership of your content.
8.2 Model Development
You also grant LaneTrax a worldwide, non-exclusive, royalty-free license to use Bowling Content to train, test, evaluate, and improve bowling-analysis systems for the separate internal model-development purposes described in the Privacy Policy, subject to applicable law and your privacy choices. Providing your requested App features and history is not the same purpose as model development. The training opt-out covers future use and removal of Personal Information from existing training and evaluation datasets as described in the Privacy Policy.
8.3 Marketing and External Licensing
Subject to the conditions in this section and the Privacy Policy, you grant us the rights you hold to use bowling footage in public marketing and to license Bowling Content to other organizations for research, analysis, and model development. External licensing is limited to Bowling Content as defined above, not an unrestricted license to unrelated User Content or account information. Recipients may use licensed content independently for the permitted purposes, subject to applicable restrictions.
Permitted research, analysis, and model development may concern subjects beyond bowling, but the recipient and its specific purposes must be established before release. This is not permission for an unidentified recipient to use content for any purpose it chooses. We will provide any additional notice and obtain any permission required for the particular use.
Associated shot data may include relevant metrics, trajectories, detections, and recording metadata within the Bowling Content definition. We will limit disclosed information to what is reasonably necessary for the specified purpose, remove direct account identifiers and linkable references where not needed, and will not include sign-in credentials, payment information, private support messages, or unrelated account-profile details. Recipient arrangements must define permitted purposes, onward disclosure, security, retention, and handling of applicable privacy requests, and prohibit unauthorized re-identification. These requirements do not enlarge the rights granted by another person or establish a lawful basis merely through these Terms.
For videos or images used in marketing or licensing, we will exclude or obscure visible faces unless we have permission to show them or applicable law permits it. We will obtain any other permissions required for the particular use, including from other people shown or heard. Hiding a face does not necessarily anonymize a recording. These Terms do not supply a required privacy consent, likeness release, or other permission merely because you accept them, and you cannot grant rights another person must grant.
These uses may involve Bowling Content collected before or after this version of the Terms takes effect, but neither these Terms nor a policy update retroactively supplies missing rights or permissions. The conditions for the particular use must be met before it begins. No payment, royalty, or attribution is automatically due for a permitted use unless separately agreed or required by law.
8.4 Duration and Privacy Limits
The content licenses last only for as long as the relevant use and retention remain permitted under this agreement, the Privacy Policy, your applicable choices, and law. Your deletion and other privacy rights continue to apply. Ending an account does not automatically undo a completed lawful use, but we will assess continuing processing and communicate requests to relevant recipients where required. A trained model is not automatically exempt from privacy law if it contains or processes Personal Information. Retention and deletion are governed by the Privacy Policy.
9. Privacy and Data Controls
We process technical data, including device, system, and application information, for software updates, support, and other purposes described in the Privacy Policy. We will handle Personal Information in accordance with that policy and applicable law.
The Privacy Policy and Tracking Technologies page explain collection, sharing, service providers, device permissions, and choices. These Terms do not classify all processing as necessary for a contract, make App use consent to all tracking, or substitute for a required separate authorization.
You may use the privacy request process for access, correction, deletion, training opt-outs, or other applicable rights. Removing a shot from visible history, signing out, disabling Replays, and requesting permanent deletion have different effects, as explained in that policy. Section 8.4 addresses the effect of privacy choices on content licenses.
10. LaneTrax Intellectual Property and Feedback
10.1 Our Technology
LaneTrax and its licensors retain their rights in the App, software, models, designs, documentation, and other technology they create or own. Rights in underlying User Content are not transferred by this provision, and ownership of a model does not remove obligations concerning Personal Information. LaneTrax names and branding may not be used in a way that falsely implies endorsement or affiliation. Other uses require permission or an applicable legal entitlement.
10.2 Feedback
If you voluntarily provide suggestions about the Services, you grant LaneTrax a non-exclusive, royalty-free license to use and incorporate those suggestions without payment or attribution, unless separately agreed or required by law. This is not an additional license to publish your private communications or license unrelated User Content. Personal Information and Bowling Content remain subject to Sections 7–9.
11. Third-Party Services and Apple Requirements
11.1 Independent Services
The App may enable access to LaneTrax's and third-party services and websites. Independent services, including Apple purchases, sign-in providers, and linked websites, may have their own terms. You must comply with applicable third-party agreements when using the App, including your wireless-data agreement and Apple's Usage Rules. These services may not be available in all languages or in your country and may not be appropriate or available for use in a particular location. You are responsible for complying with applicable laws when you choose to use them.
Subject to mandatory legal protections, you use independent third-party services at your own risk. We do not control them and are not responsible for examining or evaluating their independent content or accuracy except as required by law. This does not exclude responsibility we have for our own Services or providers acting on our behalf. Changes to services we provide remain subject to Section 12.
11.2 Responsibility for the App
You and LaneTrax acknowledge that this agreement is between you and LaneTrax, not Apple. LaneTrax will be responsible for the App and its content and will provide maintenance and support required by this agreement or law. Apple has no obligation to provide maintenance or support. LaneTrax will address claims relating to the App or your possession or use of it, including product-liability, legal or regulatory compliance, consumer-protection, and privacy claims. For a third-party claim that the App or its possession or use infringes intellectual property, LaneTrax, not Apple, is responsible for investigation, defense, settlement, and discharge.
11.3 Apple's Enforcement Rights
Apple and its subsidiaries are third-party beneficiaries of this agreement. Upon your acceptance, Apple has the right, and is deemed to have accepted the right, to enforce it against you as a third-party beneficiary in relation to the App license and related provisions required by Apple. This does not give Apple enforcement rights over unrelated standalone website or business arrangements. These Terms do not conflict with applicable Apple Media Services Usage Rules.
11.4 Export and Trade Controls
You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which you obtained it. In particular, you may not export or re-export it into U.S.-embargoed countries or to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and are not on a U.S. Government list of prohibited or restricted parties. You also agree not to use the App for any purposes prohibited by applicable export or sanctions laws.
12. Changes, Suspension, and Termination
12.1 Service Changes
We may maintain, update, or change the Services for legitimate reasons such as security, legal compliance, compatibility, reliability, improvements, or discontinuation of a feature or service. We may require compatible updates for continued use. For planned discontinuation or a material reduction of paid features, we will explain the change and its timing with reasonable advance notice and any longer notice required by law. An urgent legal or security need may require earlier action; where lawful, we will explain it as soon as reasonably possible.
If a change materially reduces the paid service for your current subscription period and you do not accept a reasonable equivalent, you may end the affected paid service and receive a proportionate refund for its unused affected period. For discontinuation, that period runs from loss of the service to the end of the paid period. We will help seek the refund through Apple and provide reimbursement if an amount owed under this commitment cannot be refunded through Apple. More favorable statutory remedies remain available.
Direct reimbursements under this section follow the timing and payment-method provisions in Section 5.6. They are not limited to a first payment or to that guarantee's 30-day request period.
Before a planned change removes access to existing shot history or a planned discontinuation, we will provide a reasonable opportunity and practical method to retrieve available content. Security, legal restrictions, or circumstances genuinely beyond our control may limit access; we will explain applicable limits where lawful. We do not use this provision to avoid obligations for a paid period or to charge for a change contrary to law.
12.2 Account Restrictions
We may restrict content or suspend or terminate access where reasonably necessary for a material breach, fraud, unauthorized sharing, security risk, unlawful content, or a legal requirement. Action will be proportionate to the circumstances. Where lawful and reasonably practicable, we will explain the reason and allow an opportunity to resolve a remediable issue. Immediate action may be necessary to protect people or systems or comply with law. Contact us to request review of an account restriction.
12.3 Ending Your Use
The App license is effective until terminated by you or LaneTrax in accordance with these Terms. You may stop using the Services, cancel renewal through Apple, or request account deletion. If your App license ends, you must stop using the App and remove your copies, except where law permits otherwise. Account termination does not prevent privacy requests. Content retention and deletion follow the Privacy Policy, not an automatic forfeiture of your rights. Ending use does not automatically cancel Apple billing; Section 5 explains the separate cancellation process.
12.4 Changes to These Terms
We will give at least 30 days' advance email notice of material changes, identifying the changes and effective date, except where a shorter period is necessary for urgent legal or security reasons and is permitted by law. In that case, we will explain the reason and give as much notice as reasonably possible. Longer mandatory notice periods still apply. Where renewed agreement or consent is required, we will obtain it rather than treating publication alone as acceptance. Changes do not retroactively supply missing permissions for content or Personal Information.
These Terms apply to both free and paid use of the Services. Accepting them or a change to them does not purchase or renew a subscription. If you do not accept a change that requires your agreement, you may stop using the Services. We will not treat silence alone as acceptance where affirmative agreement is required.
A Privacy Policy update may amend and expand the uses authorized by Section 8 if it clearly identifies those changes and we follow this section's notice and applicable agreement requirements. The update cannot grant rights you do not hold or replace consent or other permission required by law. The limits on retroactively supplying missing rights and permissions continue to apply.
Declining a change does not by itself forfeit access you have already paid for. Unless continued performance on the existing terms would be unlawful or create a serious security risk, those terms will continue for the remainder of that paid period. If we cannot continue on that basis, the proportionate refund and retrieval protections in Section 12.1 apply.
12.5 Continuing Provisions
Accrued payment obligations, intellectual-property rights, applicable limits on content use, privacy obligations, and provisions on liability, disputes, and general administration continue to the extent their purpose requires. Continuing content use remains subject to the limits in Section 8.4.
13. Warranties and Mandatory Consumer Rights
13.1 Rights That Cannot Be Excluded
Nothing in these Terms excludes or limits a guarantee, warranty, remedy, or liability that applicable law does not permit us to exclude or limit. Consumers may have rights concerning reasonable care, conformity, digital content, refunds, repair, or other remedies in their country. Those rights remain effective despite the qualifications below.
13.2 Warranty Disclaimer
To the extent permitted by law, the Services are provided "as is" and "as available," with all faults and without warranty of any kind. LaneTrax disclaims warranties and conditions, express, implied, or statutory, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy, and non-infringement, except to the extent they cannot lawfully be disclaimed. We do not warrant that the Services will be uninterrupted or error-free, that defects will always be corrected, or that they will meet every requirement. We do not promise perfect security or a particular bowling result. These qualifications do not override an express commitment we make or a mandatory standard of service.
No oral or written information or advice given by LaneTrax or its authorized representatives creates an additional warranty unless expressly agreed or required by law. Some jurisdictions do not allow exclusions of implied warranties or limitations on statutory consumer rights, so the exclusions above may not apply to you. Section 13.1 remains effective in all cases.
13.3 Apple Warranty Procedure
LaneTrax will fulfill App warranties that are not lawfully excluded. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the App; other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are LaneTrax's responsibility. This does not restrict any mandatory subscription refund or other remedy.
14. Liability and Indemnification
14.1 Mandatory Exceptions
The exclusions and cap below do not apply to fraud or willful misconduct, or to any liability that cannot lawfully be limited. This includes liability for gross negligence, death or personal injury caused by negligence, and statutory consumer or privacy remedies to the extent applicable law prohibits their exclusion or limitation.
14.2 Excluded Losses
Subject to Section 14.1 and to the maximum extent permitted by law, LaneTrax is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of or inability to use the Services, however caused, regardless of the theory of liability (contract, tort, or otherwise), and even if we have been advised of the possibility of such damages. This does not exclude a consumer loss for which applicable law requires us to remain responsible.
Lost profits, loss of data, business interruption, and other commercial losses are excluded under this section only to the extent that they fall within an excluded category above. A loss is not excluded merely because it has one of those descriptions; direct losses remain subject to Section 14.3 and applicable law.
14.3 General Liability Cap
Subject to Section 14.1, LaneTrax's total liability arising out of or relating to the affected Services for a claim or series of claims arising from the same or related events will not exceed the greater of US$100 or the fees you paid for those Services in the 12 months before the first event giving rise to those claims, including fees paid through Apple. This cap applies only where permitted by applicable law, regardless of the legal basis of the claim.
This is one aggregate cap for those related claims, not a new cap for each allegation or legal theory. It does not reduce refunds, reimbursements, or other payment obligations expressly owed under these Terms, including Sections 5.6 and 12.1, or any non-excludable remedy.
Subject to Section 14.1, the foregoing limitations apply even if a limited remedy fails of its essential purpose, but only to the extent permitted by applicable law.
14.4 Claims Caused by Your Breach
This contractual defense and indemnity applies only to the business customer for use in its business, not to an individual acting as a consumer or a worker merely operating the business's account. To the extent permitted by law, the business agrees to defend and indemnify LaneTrax against third-party claims, damages, and reasonable legal costs caused by its unlawful use of the Services or breach of these Terms, including missing recording permissions or infringement of another person's rights. This obligation applies only to the extent the claim is attributable to the business's conduct, not LaneTrax's breach, negligence, or other fault, and does not impose an obligation prohibited by consumer law.
We will notify the business reasonably promptly of a claim; delayed notice reduces its obligation only to the extent the delay materially prejudices the defense. The business may control the defense using competent counsel reasonably acceptable to us and must keep us reasonably informed. We may participate with our own counsel at our expense, except that reasonable separate counsel costs caused by a material conflict of interest form part of the indemnified costs to the extent attributable to the business's covered conduct. We will reasonably cooperate at the business's expense. If the business fails to assume a required defense after reasonable notice, we may defend the claim and seek reasonable covered costs. Neither party may agree to a settlement imposing an admission, payment, or other obligation on the other without that party's consent, not to be unreasonably withheld.
Consumers have no contractual duty to defend or indemnify us under this section. This does not remove either party's ordinary legal responsibility for its own conduct or LaneTrax's burden to establish a claim and recoverable loss under applicable law.
15. Governing Law and Disputes
15.1 Contact and Voluntary Resolution
Please contact us about a dispute so we can try to resolve it. Either party may agree to mediation after a dispute arises. Contact or mediation is not a mandatory condition of filing a claim, does not shorten a limitation period, and does not prevent urgent relief, a small-claims action, or a regulatory complaint.
15.2 Governing Law and Courts
You and LaneTrax agree that Illinois law governs these Terms, excluding its conflict-of-law rules, except that you retain the mandatory protections of the law applicable to you. Subject to those protections, courts of competent jurisdiction in Cook County, Illinois, or the United States District Court for the Northern District of Illinois will hear disputes under these Terms.
If mandatory consumer law entitles you to bring proceedings in your home jurisdiction or another forum, that right is unaffected; any restriction on where we may bring a claim against you also remains effective. These Terms do not require arbitration or waive a right to participate in a class or representative action available under applicable law.
16. General Provisions and Contact
16.1 Agreement Documents
These Terms and any expressly applicable offer terms form the agreement concerning the Services. The Privacy Policy governs Personal Information as explained in Section 1. No provision removes a representation, remedy, or right that cannot lawfully be excluded. Apart from Apple's rights under Section 11.3 and any rights required by law, no third party receives enforcement rights under these Terms.
For a particular promotion, its expressly presented terms control its eligibility, price, duration, qualifying actions, and rewards. These Terms control other contractual matters, including dispute resolution, except for a separately negotiated agreement that expressly identifies a different provision. An offer does not by itself expand a content license. Privacy Policy updates may amend the uses authorized by Section 8 through the process in Section 12.4. Neither overrides mandatory rights. Earlier accepted offer terms and accrued benefits are not retroactively replaced merely by publishing this version; any amendment requires the notice and acceptance applicable to that agreement and law.
These Terms do not create an agency, partnership, joint venture, or employment relationship between LaneTrax and you. Coaches, centers, and other business users operate independently and are responsible for their own services, fees, customer agreements, and legal obligations. Without permission, you may not bind LaneTrax, make commitments on our behalf, or claim our endorsement. This does not reduce LaneTrax's own obligations under these Terms or applicable law.
16.2 Transfers
You may not transfer your account except with our written agreement or as required by law. Transfer of the App remains subject to Section 3 and Apple's applicable Usage Rules. We may transfer this agreement in connection with a business transfer if the successor assumes our obligations and the transfer does not reduce your mandatory rights. Personal Information remains subject to the Privacy Policy and applicable law.
16.3 Enforceability and Events Beyond Control
If a provision is unenforceable, the remainder continues to the extent lawful and consistent with the agreement's purpose. Failure to enforce a provision once is not a waiver of future enforcement. Events beyond reasonable control may affect performance, but do not remove required care, notice, refunds, or other mandatory obligations.
16.4 Notices
We may send service and legal notices to your account email or through the Services, subject to any required delivery method. Keep your account email reasonably current. Material changes to these Terms follow Section 12.4. You may send notices, complaints, or questions to the contact below; privacy requests may also use the Privacy Policy's request process.
